Who we are

PTC (Pedro Torres Cobas) is the creator and owner of the content, frameworks, and intellectual property offered through these Services.

The commercialisation, sales, marketing, billing, and payment processing of the Services are carried out by ONCKY GmbH, Oetlingerstrasse 75A, 4057 Basel, Switzerland, acting as the authorised commercial and operational partner of PTC. Depending on the Service, your contractual counterparty may be PTC and/or ONCKY GmbH, as indicated at checkout, on invoices, or in specific agreements.

1) Scope & Acceptance

These Terms & Conditions (“Terms”) govern your access to and use of our websites (including ptorrescobas.com and go.ptorrescobas.com) and our offerings: downloads, newsletters, courses, seminars (online and in-person), workshops, memberships, and advisory (collectively, the “Services”). By using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

2) Who may use the Services

You must be at least 16 years old (or the age of digital consent in your country) and able to form a binding contract. If you use the Services on behalf of a company, you represent that you are authorized to accept these Terms for that entity.

3) Accounts & Communications

Some Services require an account or an email subscription. You agree to provide accurate information and keep it up to date. We may send you transactional messages (e.g., downloads, event details, receipts). You can unsubscribe from marketing anytime.

4) Purchases, Pricing & Taxes

Prices are shown in CHF unless stated otherwise and may include VAT where applicable. We may change prices at any time (changes do not affect completed purchases). Payments are processed by trusted third parties (e.g., Stripe, PayPal, Postfinance). You authorize us and our processors to charge your payment method for all purchases, including recurring subscription fees where applicable.

4.1) Commercial Representation & Contracting Party

PTC has appointed ONCKY GmbH as its authorised commercial partner to represent, market, sell, and distribute the Services. ONCKY GmbH is authorised to:

• market and promote the Services;
• enter into contracts with customers on behalf of PTC or in its own name;
• process payments, issue invoices, and manage subscriptions;
• provide customer communication related to sales, access, and delivery.

All intellectual property rights remain with PTC unless expressly stated otherwise in writing. The applicable contracting party (PTC and/or ONCKY GmbH) will be clearly identified at the point of purchase, on invoices, or in specific agreements.

5) Subscriptions (Membership)

Memberships bill in recurring periods (e.g., monthly). You can cancel at any time from your account or by contacting us; cancellation stops future billing but does not refund the current paid period unless required by law. We may offer trial periods or promotions; specific terms shown at checkout apply.

6) Events & Programs

Online seminars (paid): Full refund if you cancel at least 48 hours before the start time. Within 24 hours, you may transfer your ticket to a future date (one time) at no charge.

In-person workshops (paid): Full refund up to 7 days before the event. Between 7 days and 48 hours, you may transfer your ticket to a future date or another attendee. Within 48 hours, transfers only (no refund).

Bootcamps/cohorts (multi-week): If offered, you may request a full refund before the second live session begins; thereafter, refunds are not provided, but cohort transfers may be possible case-by-case.

Our right to reschedule: We may reschedule or change format (e.g., move to online) due to circumstances beyond our control. If we cancel without offering a comparable alternative, you will receive a full refund of fees paid for that event.

7) Digital Products & Downloads

Lead magnets are free. Paid digital products (e.g., planners, templates, recordings) are delivered electronically upon purchase. Due to the nature of digital content, sales are generally final once access is granted. If you have technical issues or accidental duplicate purchases, contact us within 7 days—we’ll make it right.

EU/EEA consumers: When you purchase digital content and opt to receive it immediately, you acknowledge you waive the 14-day withdrawal right for that specific content, as required by law.

8) Advisory & Coaching-style Services

Where we offer advisory or strategy sessions, we provide educational and strategic guidance. You remain responsible for your decisions, implementation, and outcomes. See Section 12 (Disclaimers) and Section 13 (Limitation of Liability).

9) Intellectual Property & License

All content we publish or provide, including the One Focus Goal (OFG) framework, playbooks, worksheets, videos, podcasts, slides, and site content (collectively, “PTC Content”), is owned by Pedro Torres Cobas (PTC) or licensed to us.

Unless we grant a different license in writing, we grant you a personal, non-exclusive, non-transferable license to use PTC Content for your own use. You may not resell, redistribute, publish, sublicense, post publicly, or use the content to create competing products or services without our written consent. Limited internal team use is allowed for paying business customers if explicitly stated at purchase.

PTC may license or authorise affiliated entities, including ONCKY GmbH, to commercialise, distribute, and provide access to PTC Content.

10) Acceptable Use

You agree not to:

• misuse the Services, interfere with their operation, or attempt to access them using methods other than the provided interfaces;
• copy, share, or publicly post PTC Content beyond the permitted license;
• reverse engineer or attempt to extract source code from our websites or tools;
• upload unlawful, defamatory, or infringing material;
• use the Services to advertise or promote unrelated products without permission.

We may suspend or terminate access if we reasonably believe you violated these Terms.

11) User Content & Testimonials

If you submit comments, survey answers, testimonials, or community posts (“User Content”), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content for operating and improving the Services and for marketing, subject to any permission we request for named testimonials. Do not submit confidential or sensitive information unless requested.

12) Disclaimers (No Professional Advice)

PTC Content is for educational purposes. We do not provide medical, legal, tax, or financial advice. Any “energy,” “health,” or “performance” suggestions are general and not a substitute for professional advice. You are responsible for assessing suitability and seeking professional guidance where appropriate. Results vary and are not guaranteed.

13) Limitation of Liability

To the fullest extent permitted by law, PTC and its affiliates, partners, and personnel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising from or related to your use of the Services. Our total liability for any claim is limited to the amount you paid to us for the specific Service in the 12 months preceding the claim (or CHF 100 for free Services).

14) Indemnification

You agree to indemnify and hold PTC harmless from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your misuse of the Services or violation of these Terms.

15) Force Majeure

We are not responsible for delays or failures caused by events outside our reasonable control (e.g., internet outages, platform failures, strikes, epidemics, government actions, natural events).

16) Changes to the Services and Terms

We may modify the Services and these Terms from time to time. Changes take effect upon posting on the site with an updated “Effective date.” For material changes, we may notify you via email or a site notice. Your continued use after changes means you accept the updated Terms.

17) Third-Party Links & Tools

The Services may link to third-party sites or integrate third-party tools (e.g., Zoom, Stripe). We are not responsible for third-party content or practices. Use them at your discretion and review their policies.

18) Governing Law & Jurisdiction

These Terms are governed by the laws of Switzerland, without regard to conflict-of-law rules. Exclusive place of jurisdiction is Basel-Stadt, Switzerland. Mandatory consumer protection rules of your country of residence may still apply if required by law.

19) Severability & Waiver

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce a right is not a waiver of that right.
